Partial benefit for termination of professional activity

Self-employed workers with entrepreneurial activity and managers and company directors who claim or are receiving the benefit for termination of professional activity and begin to work as employees with a part time contract or an independent activity.

Eligibility conditions Eligibility conditions

  • To have a presented a claim or already receiving the benefit for termination of professional activity
  • To have, at the time or later, professional activity as an employee with a part time contract or a normal weekly work period that is inferior to a full work period in a comparable situation, provided the work earnings are less than the amount of the benefit for termination of professional activity, or
  • To have, at the time or later, professional activity as a self-employed worker, provided the relevant income from the activity is less than the amount of the benefit for termination of professional activity.

Duration Duration

The benefit is paid during the period of part time work but limited to the period of concession of the benefit for termination of professional activity.

Amount Amount

  • Corresponding to the difference between the amount of the benefit for termination of activity plus 35% of the same, and work earnings as an employee
  • Corresponding to the difference between the amount of the benefit for termination of professional activity plus 35% of the same, and the amount of one twelfth of the relevant annual income presumed by the beneficiary for fiscal purposes, when the beneficiary has professional activity as a self-employed worker
  • Remains the same as the benefit for termination of professional activity when the following conditions are complied with cumulatively:
    • The benefit for termination of professional activity plus 35% results in an amount that is less than the guaranteed minimum monthly wage
    • The sum total of the work earnings, as an employee or a self-employed worker, and the partial benefit for termination of professional activity is less than the guaranteed minimum monthly wage.
  • Cannot be more than the amount of the corresponding benefit for termination of professional activity
  • Is subject to recalculation whenever the presumed amount is not confirmed.

Documents to be submitted:

The worker must provide proof within 90 days of the date he began work:

  • of the type of activity performed
  • of the monthly remuneration of the part-time employee or the gross amount of the self-employed activity.
